Code of Criminal Procedure, 1973 Section 383

Title: Procedure when Appellant in Jail

State: Central

Year: 1973

If the appellant is in jail, he may present his petition of appeal and the copies accompanying the same to the officer in charge of the jail, who shall thereupon forward such petition and copies to the proper Appellate Court. STATE AMENDMENT 1Andaman and Nicobar Islands and Lakshadweep: In section 383, the following words shall be inserted at the end, namely:- "or if, by reason of the weather, transport or other difficulties, it is not possible to forward them to the proper Appellate Court they shall be forwarded to the Administrator or an Executive Magistrate, not below the rank of a Sub-Divisional Magistrate, who shall, on receipt of such petition of appeal and copies, record thereon the date of receipt thereof and thereafter forward the same to the proper Appellate Court. ______________________ 1. Indian Penal Code (45 of 1860) Section 383

Title: Extortion

.....in fear to deliver to any person any property or valuable security, or anything signed or sealed which may be converted into a valuable security, commits "extortion". Illustrations (a) A threatens to publish a defamatory libel concerning Z unless Z gives him money. He thus induces Z to give him money. A has committed extortion. (b) A threatens Z that he will keep Z's child in wrongful confinement, unless Z will sign and deliver to A a promissory note binding Z to pay certain monies to A. Z signs and delivers the note. A has committed extortion. (c) A threatens to send club-men to plough up Z's field unless Z will sign and deliver to B a bond binding Z under a penalty to deliver certain produce to B, and thereby induces Z to sign and deliver the bond. A has committed extortion. (d) A, by putting Z in fear of grievous hurt, dishonestly induces Z to sign or affix his seal to a blank paper and deliver it to A. Z signs and delivers the paper to A. Here, as the paper so signed may be converted into a valuable security. A has committed extortion.

Indian Succession Act, 1925 Section 383

Title: Revocation of Certificate

A certificate granted under this Part may be revoked for any of the following causes, namely: (a) that the proceedings to obtain the certificate were defective in substance; (b) that the certificate was obtained fraudulently by the making of a false suggestion, or by the concealment from the Court of something material to the case; (c) that the certificate was obtained by means of an untrue allegation of a fact essential in point of law to justify the grant thereof, though such allegation was made in ignorance or inadvertently; (d) that the certificate has become useless and inoperative through circumstances; (e) that a decree or order made by a competent Court in a suit or other proceeding with respect to effects comprising debts or securities specified in the certificate renders it proper that the certificate should be revoked.

Title: Decision of Disputes as to Whether Places Are Markets

If any question arises whether any place where persons assemble for the sale or purchase of articles of food or clothing, or live-stock or poultry, or cotton, groundnut or other industrial crops or of any other raw or manufactured products, is a market or not, the Commissioner shall make a reference to the Government and the decision of the Government on the question shall be final.

Merchant Shipping Act, 1958 Section 383

Title: Constitution of Court of Survey

(1) A court of survey for a port shall consist of a Judge sitting with two assessors. (2) The Judge shall be a District Judge, Judge of a court of small causes,1[Metropolitan Magistrate, Judicial Magistrate of the first class] or other fit person appointed in this behalf by the Central Government either generally or for any specified case. (3) The assessors shall be persons of nautical, engineering pr other special skill or experience. (4) Subject to the provisions of Part IX as regards ships other than Indian ships, one of the assessors shall be appointed by the Central Government either generally or in each case and the other shall be summoned by the. Judge in the manner prescribed out of a list of persons from time to time prepared for the purpose by the Central Government or, if there is no such list or if it is impracticable to procure the attendance of any person named in such list, shall be appointed by the Judge. _______________________ 1. Title: Power to Institute, Etc., Legal Proceedings and Obtain Legal Advice

.....The Chairperson may-- (a) take, or withdraw from, proceedings against any person who is charged with-- (i) any offence against this Act or any rules, regulation or bye-law made thereunder; or (ii) any offence which affects or is likely to affect any property or interest of the Council or the due administration of this Act; or (iii) committing any nuisance whatsover; (b) contest or compromise any appeal against rateable value or assessment of any tax or rate; (c) take, or withdraw from , compromise proceedings under sections 360, 361 and 362 for recovery of expenses or compensation claimed to be due to the Council; (d) withdraw or compromise any claim for a sum not exceeding one thousand rupees against any person; (e) defend any suit or other legal proceeding brought against the Council or against the Chairperson or a municipal officer or municipal employee in respect of anything done or omitted to be done by any one of them in his official capacity; (f) with the approval of the Council admit or compromise any claim, suit or other legal proceeding brought against the Council or against the Chairperson or any officer or other employee in respect of anything done.....
