The Punjab Land Reforms Act, 1972 Complete Act

.....[----] (15) "surplus area" means the area in excess of the permissible area; (16) "tenant" has the meaning assigned to it in the Punjab Tenancy Act, 1887 (Act XVI of 1887) and includes a sub-tenant and self-cultivating lessee, but shall not include a present holder as defined in clause (f) of section 2 of the East Punjab Displaced Persons (Land Resettlement) Act, 1949; (17) all other words and expressions used herein and not defined but defined in the Punjab Tenancy Act, 1887 (Punjab Act XVI of 1887), or the Punjab Land Revenue Act, 1887 (Punjab Act XVII of 1887) shall have the meaning assigned to them in either of those Acts. COMMENTS Tenant on appointed day " if the petitioner was a tenant on the appointed day and had continued to be a tenant continuously it would be manifestly unfair to deprive him of tenants permissible area merely because he subsequently purchased a part of the tenancy. EAST PUNJAB URBAN RENT RESTRICTION ACT, 1949 EAST PUNJAB URBAN RENT RESTRICTION ACT, 1949 An Act to restrict the increase of rent of certain premises situated within the limits of urban areas, and the eviction of tenants therefrom It is hereby enacted as follows:- 1. Short title, extent and commencement. - (1) This Act may be called the East Punjab Urban Rent Restriction Act, 1949. (2) It extends to all urban areas in 1[Punjab] but nothing herein contained shall be deemed to affect the regulation of house accommodation in any Cantonment area. (3) It shall come into force at once. Footnotes: 1. Substituted for "East Punjab" by the Adaptation of Laws Order, 1950. 2. Definitions . - In this Act, unless there is anything repugnant in the subject or context:- (a)"building" means any building or part of a building let for any purpose whether being actually used for that purpose or not, including any land, go-downs, out-houses, or furniture let therewith, but does not include a room in a hotel, hostel or boarding-house; (b) "Controller" means any person who is appointed by the 1[State] Government to perform the functions of a Controller under this Act: .....

The Ganga and Ghaghra rivers and their high banks wherever mentioned in this Schedule have reference to the geographical river or high bank positions, as the case may be, as shown in the survey records mentioned in the foregoing paragraph. Accordingly, the portion of the present alignment of the above mentioned existing fixed boundary between this point and the present Ganga river wilt cease to be the boundary between the States of Bihar and Uttar Pradesh. 2. SECTION 14: ARREARS OF TAXES - The right of Bihar or Uttar Pradesh to recover arrears of any tax or duty on property situate in the transferred territories, including land revenue, or to recover arrears of any other tax or duty in any case where the place of assessment of that tax or duty is in the transferred territories shall belong to the State to which the territories are transferred. SECTION 15: RIGHT TO RECOVER LOANS AND ADVANCES - The right to recover any loans or advances made before the appointed day by Bihar or Uttar Pradesh to any local body, society, agriculturist, or other person in the transferred territories shall belong to the State to which the territories are transferred. SECTION 16: REFUND OF TAXES COLLECTED IN EXCESS - The liability of Bihar or Uttar Pradesh to refund any tax or duty on property situate in the transferred territories, including land revenue, collected in excess shall be the liability.....

The Code of Criminal Procedure, 1973 Complete Act
