(1) The State Government may by notification, make rules to carry out all or any of the purposes of this Act. (2) In particular and without prejudice to the generality of the foregoing power, rules may be made,- (a) to prescribe and limit the powers and duties of any Forest Officer under this Act; (b) to regulate the procedure of Forest Settlement Officers; ( c) for the preservation, reproduction and disposal of trees, timber and other forest produce belonging to Government, but grown on lands be longing to or in the occupation of private persons; ( d) to regulate the rewards to be paid to officers and informers out of the proceeds of fines and confiscation under this Act or otherwise. 1[(e) to regulate the cutting, felling, sale or disposal of blackwood or bite tree (Dalbergia Latifolia); (f) to prescribe the fees to be levied in respect of licences, permits, passes or permissions issued under this Act or rules made thereunder; (g) in respect of any other matter which is required or allowed by this Act to be prescribed]; ______________________ 1. (6)The State Government or the aforesaid officers subject to the generalsupervision and control of the State Government shall be bound to purchase atthe price fixed under sub-section (4) any such tree or timber offered for saleduring the hours of business. Substitution of section 6.-- For section 6 of the principal Act, the following section shall be substituted, namely:-- "6. Right of owners to cut and remove trees in non-notified areas in non-forest land.-- (1) Notwithstanding anything contained in any other law for the time being in force and subject to the other provisions of this Act, every owner of non-forest land in a non-notified area shall have the right to cut and transport any tree, other than sandalwood tree, standing on his land: Provided that the provision of this sub-section shall not apply to trees, if any, reserved by the Government at the time.....

THE KERALA PRESERVATION OF TREES ACT, 1986[1] THE KERALA PRESERVATION OF TREES ACT, 1986[1] (ACT 35 OF 1986) An Act to provide for the preservation of trees in the State of Kerala. Preamble.-WHEREAS there has been indiscriminate felling and destruction of trees, in the State of Kerala resulting in considerable soil erosion and destruction and loss of the timber wealth of the State; AND WHEREAS with a view to prevent soil erosion and destruction and loss of the timber wealth in the State, it is necessary to regulate the felling and destruction of trees in the State; BE it enacted in the Thirty-seventh Year of the Republic of India as follows:- 1. Short title, extent and commencement.-This Act may be called the Kerala Preservation of Trees Act, 1986. (2) It extends to the whole of the State of Kerala. (3) It shall be deemed to have come into force on the 18th day of June, 1983. 2. Explanation .--The terms "vehicle" and "boat" in this section, sections 10 and 11 shall include all the articles and machinery kept in the vehicle or boat, as the case may be, whether fixed to the same or not. (2) Every officer seizing any timber under sub-section (1) shall, place on such timber a mark indicating that the same has been so seized and shall, as soon as may be, make a report of such seizure to the Forest Range Officer having jurisdiction over the area.
