An Act to amend the Court-fees Act, 1870 In its application to the State of Orissa

Be it enacted by the legislature of the State of Orissa in the Twenty-fifth Year of the Republic of India, as follows:

Statement of objects and Reasons.-- For mobilisation of additional resources for financing the Fifth Five Year Plan of the State the Working Group of Financial Resources recommended increase of the rate of court-fee chargeable under the Court-fees Act, 1870 in respect of certain items covered by Schedule II of the said Act. The Resources Working Group having approved the said recommendation of the Government have decided to give effect to the proposed increase in the rate of court-fee by amending the relevant articles of the said Schedule.

The bill seeks to achieve the above purpose.

This Act may be called the Court-fees (Orissa Amendment) Act, 1974.

In Schedule II to the Court-fees Act, 1980( Act 7 of 1870).

(a) in Article 1, the entries occurring under the heading "proper fee" as mentioned in Column (1) of the following Schedule shall respectively be substituted by the entries shown against them in Column (2) thereof:

1. Ten naye paise	Thirty paise.
2. In the case of a criminal complaint and appeal, one rupee and in other cases seventy-five naye paise.	In the case of a criminal complaint and appeal, one rupee and fifty paise and in other cases eighty paise.
3. One rupee and fifty naye paise	One rupee and sixty-five paise.
4. Five rupees	Five rupees and fifty paise.
5. Ten rupees	Eleven rupees.
6. Two rupees	Two rupees and twenty paise.

(b) in Article 1-A, for the words "one rupee", the words "one rupee and ten paise" shall be substituted;

(c) in Article 2, for the words "fifty naye paise" the words "fifty five paise" shall be substituted;

(d) in Article 3, for the words "one rupee", the words "one rupee and ten paise" and for the words "two rupees", the words "two rupees and twenty paise" shall be substituted;

(e) in Article 10, for the words "one rupee", the words "one rupee a.-and fifty paise" and for the words "two rupees", the words "two rupees and fifty paise" and for the words "three rupees" the words "four rupees" shall be substituted;

(f) in Article 13, for the words "five rupees", the words "five rupees and fifty paise" shall be substituted;

(g) in Article 14, for the words "ten rupees", the words "eleven rupees" shall be substituted;

(h) for Article 18, the following article shall be substituted, namely :

"18. Application under Section 14 of the Arbitration Act, 1940 for a direction paise". for filing an award or under Section 20 of that Act for an order for filing ah agreement	"Sixteen rupees and fifty

(i) in Article 20, for the words "thirty rupees", the words "thirty-three rupees" shall be substituted.
