An Act to fix the salary and allowances of the Speaker of the Nagaland Legislative Assembly.

Preamble. -
WHEREAS it is expedient to fix
the salary and allowances
of the Speaker of
the Nagaland Legislative Assembly in the manner hereinafter appearing;
It is hereby enacted in the Fifteenth Year of the Republic of India as follows
;

1. Short title and commencement. -
(1) This Act may be called the Nagaland Speaker's Salary and Allowances Act, 1964.
(2) It shall be deemed to have come into
force with effect from the 11th February, 1964.

2. Salary of the Speaker. -
There shall be paid to the Speaker of the
Nagaland Legislative Assembly
a salary of rupees one thousand per mensem.

3. Residence of the Speaker. -
(1) The Speaker shall be provided with free furnished residence with grounds appurtenant thereto, in Kohima throughout the
year, and also at any other place which the state Government may, from time to time, for the purpose of this Act declare to be the headquarters of Government, for so long as such declaration remains in force or at a place where the Nagaland Legislative Assembly meets.
(2)
Such residence and the grounds appurtenant thereto, shill be maintained at the public expense which shall not exceed the
amount prescribed by rules:
Provided that if the Speaker does not occupy the free furnished
residence provided by the Government, a house rent allowance at the rate of rupees two hundred and fifty per mensem and such service allowances as may be prescribed by rules shall be paid, in lieu of such residence.

Explanation.
For the purpose of this section the expression "the public expense" shall include such expenses as may be
prescribed by rules.

4. Conveyance and conveyance, allowance for the Speaker. -
(1) The State Government may, from time to time, purchase and provide suitable
conveyance for the use of the Speaker and may, by rules, provide for their maintenance and repair.
(2) The Speaker shall further be entitled to a conveyance allowance of rupees two hundred and fifty per mensem.
Provided that if the Speaker chooses to maintain his own car he shall be entitled to a conveyance allowance of rupees three hundred per mensem.

5. Prohibition against practising any profession or drawing salary as member during the tenure of the office as Speaker. -
The Speaker $ball not, during the tenure of his office for which he draws salary and allowance
.
(a)
practice any profession or engage in any trade or undertake for remuneration any employment other than his duties as speaker; or
(b)
be entitled to any salary or allowances as a member of the Nagaland Legislative Assembly.

6. Use of free furnished

residence and Government conveyance on relinquishing office. "
The Speaker shall be entitled to the privileges of the free-furnished residence an
d Government conveyance on his ceasing to hold office such period as may be prescribed by rules.

7. Travelling and daily allowances. -
The Speaker shall be entitled while touring on public business,
to travelling and daily allowances at such rates and on such conditions as may be prescribed by rules.

8. Medical attendance and treatment. "
The Speaker
shall be entitled free of charge to accommodation in hospitals maintained or approved in this behalf by the Government and also to free medical treatment.

Explanation.-
For the purpose of this section, the Speaker shall include his wife, his children, step-children, minor brothers
and sisters and parents wholly dependent on him.

9. Entertainment allowance. -
The Speaker shall
be entitled to an entertainment allowance of rupees three hundred and fifty per mensem.

10. Power to make rules.-
(1) The State Government may, by notification in the Official Gazette and in consultation
with the speaker, make rules for carrying out the purposes of this Act.
(2)
All rules made under this Act shall be laid before the Nagaland Legislative Assembly as soon as may be, after they are made and shall be subject to such modification as the Legislative Assembly may make.
(b)
To each Minister, a salary of Rupees Nine Thousand per mensem.
(c)
To each Minister of State, a salary
of Rupees Eight Thousand Five Hundred per
mensem.
(d) To each Deputy Minister, a salary of Rupees Eight Thousand Three Hundred per mensem.
(e) To each Parliamentary Secretary, a salary
of Rupees Eight Thousand Three Hundred per mensem.
3. AMENDMENT OF SECTION 4,
Sub-section (2) of Section4 of the Principal Act shall be deleted.

to amend the Nagaland Speaker's salaries and allowances Act, 1964.
Whereas it is expedient to amend the Nagaland Speaker's salaries and Allowances Act, 1964 (Nagaland Act No.
5 of 1964) in the manner here under appearing
:
It is hereby enacted in the fiftieth year of the Republic of India as follows:

1. SHORT TITLE AND COMMENCEMENT.
(i) This Act may be called the NAGALAND SPEAKER'S SALAIUES AND ALLOWANCES (AMENDMENT) ACT, 1999.
(ii) It shall come into force on such date as the state Government may by notification in official gazette appoint.

2.

AMENDMENT OF SECTION 2
Section 2 of the Nagaland Speaker's salaries and allowances act 1964 (Nagaland Act. No. 4 of 1964), shall be substituted by the following as hereunder:
There shall
be paid to the Speaker of the Nagaland Legislative Assembly a salary of rupees nine thousand per Mensem.

3. AMENDMENT OF SECTION 4
Sub-section (2) of section 4 of the Principal Act shall be deleted.

4. AMENDMENT OF SECTION 9
Section 9 of the Principal Act shall be substituted by the following as hereunder:
The Speaker shall be entitled to an entertainment allowance of rupees two thousand five hundred per mensem.
