THE PAYMENT OF SALARIES AND ALLOWANCES


(SECOND AMENDMENT) ACT, 1991


(ACT 26 OF 1991)

An Act further to amend the Payment of Salaries and Allowances Act, 1951.

Preamble." whereas it is expedient further to amend the Payment of Salaries and Allowances Act, 1951 for the purposes hereinafter appearing;

be it enacted in the Forty-second Year of the Republic of India as follows: "

1. Short title and commencement. " (1) This Act may be called the Payment o f Salaries and Allowances (Second Amendment) Act, 1991.

(2) It shall be deemed to have come into force on the 1st day of O ctober, 1991.

2. Insertion of new section 5C."After section 5B, of the Payment of Salaries a nd Allowances Act, 1951 (Act XIV of 1951) (hereinafter referred to as the principal Act), the following shall be added as section 5C, namely:"

"5C. Accident Insurance to Members of Legislative Assembly." (1) Subject t o such rules as may be made by the Government in this behalf, every member of the Legislative Assembly including the Ministers, the Speaker, the Deputy Speaker, the Leader of the Opposition and the Chief Whip shall be entitled to be insured for an amount not exceeding two lakhs rupees at the expense of the Government against accidents or other infirmities as may be specified in this behalf caused to him during his tenure as member of the Legislative Assembly, the Minister, the Speaker, the Deputy Speaker, the Leader of the Opposition and the Chief Whip, as the case may be.

(2) In the case of Ministers, the Speaker, the Deputy Speaker, the Leader of the Opposition and the Chief Whip, the insurance provided in sub-section (1) shall be in addition to the accident insurance provided in Section 5B".

3. Amendment of Section 8."In section 8 of the principal Act, in sub-sec tion (1),"

(i) in clause (aa), for the words "four hundred rupees" the words "eight hundred rupees" shall be substituted;

(ii) in the proviso to clause (b), for the words "one thousand two hundred and fifty rupees", the words "two thousand rupees" shall be sub stituted.

4 Amendment of section 8A." In section 8A of the principal Act, "

(a) in sub-section (5), for the words "five hundred rupees" the words "one thousand rupees" shall be substituted.

(b) after sub-section (5), the following sub section shall be inserted namely:"

"(6) Subject to such rules as may be may be made in this behalf every member referred to in sub-section (1) shall be entitled to the services of an Officer of his choice not above the rank of a Senior Grade Assistant in the Government Secretariat and who is in the service of the Government or a local authority or any Corporation owned or controlled by the Government or any other authority specified by the Government in this behalf to assist him in the performance of his duties as such member.".

5. Amendment of section 9 A." In section 9 A of the principal Act, in sub- section (1), for the words "fifteen thousand rupees ", the words "twenty-five thousand rupees" shall be substituted.

6 . Amendment of the Schedule. "In the Schedule to the principal Act in paragraph I, for sub-clause (a) of clause (1) the following sub-clause shall be substituted, namely:"

"(a) for journeys by road irrespective of the distance travelled at the rate of rupees two and paise fifty per kilometer subject to a minimum of seventy-five rupees per day."
