THE PAYMENT OF SALARIES AND ALLOWANCES (AMENDMENT) ACT, 1974 [1]

An Act further to amend the Payment of Salaries and Allowances Act, 1951

.

Preamble."WHEREAS, it is expedient further to amend the Payment of Salaries and Allowances Act, 1951, for the purposes hereinafter appearing.

BE it enacted in the Twenty-fifth Year f the Republic of India as follows:--

1.Short title and commencement."(1) This Act may be called the Payment of Salaries and Allowance (Amendment) Act, 1974.

(2) It shall come into force on such date as the Government may, by notification in the Gazette, appoint.

2. Amendment of section 2."In section 2 of the Payment of Salaries and Allowances Act, 1951 (XIV of 1951) (hereinafter referred to as the principal Act), after clause (b), the following clause shall be inserted namely:--

" (c) ˜first grade officer', means an officer classified as a first grade officer under rule 1 of Part II of the Kerala Service Rules, 1959."

3. Amendment of section 3."In section 3 of the principal Act, for the words "eight hundred rupees", in both the places where they occur, the words "one thousand rupees" shall be substituted.

4.Amendment of section 4."In section 4 of the principal Act,--

(i) in sub-section (1), for the words "eight hundred rupees" in both the places where they occur, the words "one thousand rupees" shall be substituted;

(ii) in clause (a) of sub section (2), for the words "five hundred rupees", in both the places where they occur, the words "seven hundred and fifty rupees" shall be substituted.

5. Amendment of section 5A"In the Explanation to section 5A of the principal Act,-

(a) the brackets and figure "(1)" shall be omitted ;

(b) paragraph (ii) shall be omitted.

6.Amendment of section 9."In section 9 of the principal Act, after sub-section (2), the following sub-section shall be inserted, namely:-

"(3) Notwithstanding anything contained in sub-section (1), but subject to such rules as may be made by the Government in this behalf, any member of the Legislative Assembly entitled to a pass under the said sub-section may opt to travel by special conveyance, and a member making such option shall not be entitled to such pass".

7. Amendment of section 9A."In section 9A of the principal Act, to sub-section (3), the following proviso shall be added, namely:-

"Provided that a member who performs such journey inside the State for attending a meeting of the Legislative Assembly or any committee thereof shall be entitled to incidental expenses at the rates applicable to first grade officers of Government.".

8. Amendment of Schedule."In the Schedule to the principal Act,--

(a) in paragraph I, -

(i) in clause (1), in sub-clause (a), for the words "thirty-two paise" and "forty paise", the words "forty-five paise" and "fifty-five paise" shall respectively be substituted;

(ii) in clause (2), for the words "thirty-two paise" and "forty paise", the words "forty-five paise" and "fifty-five paise" shall respectively be substituted;

(b) in paragraph III,--

(i) in clause (1),--

(A) for the words "twenty paise" and "thirty-two paise", the words "thirty-two paise" and "forty-five paise" shall respectively be substituted;

(B) after the proviso, the following proviso shall be inserted, namely:

"Provided further that in the case of members who have opted to travel by special conveyance, travelling allowance shall be paid at the rates applicable to first grade officers of Government;";

(ii) in clause (2), for the words "twenty paise", the words "thirty two paise" shall be substituted.
