THE MADRAS LIGNITE (ACQUISITION OF LAND) ACT, 1953

[Act No. 11 of 1953]

PREAMBLE
An Act to provide for the acquisition of lands in the lignite-bearing areas in the South Arcot District
WHEREAS the State Government commenced mining operations in the lignite bearing areas in the South Arcot district on the 28th April, 1947, with a view to exploit and utilize the mineral;
AND WHEREAS it is necessary, in acquiring lands in those areas to disregard speculative purchases of lands consequent on the prospect of their acquisition by the State Government;
AND WHEREAS the State Government had, in their press Note, dated the 6th October, 1948, informed the public that legislation for the said purpose would be undertaken;
It is hereby enacted as follows:-

Section 1 - Short title, extent and commencement
(1) This Act may be called The Madras Lignite (Acquisition of Land) Act 1953.
(2) It extends to the village in the South Arcot district which are specified in the Schedule.
(3) It shall come in to force on such date as the State Government may, by notification in the Fort St. George Gazette, appoint.

Section 2 - Acquisition of lands in lignite-bearing areas
(1) The State Government shall be entitled to acquire any land in the area to which Act extends, for the purpose of exploiting and utilizing the mineral in such land.
(2) The acquisition shall be made in accordance with the provisions of the Land Acquisition Act, 1894 (Central Act 1 of 1894), subject to the following modifications:-
(i) In section II of the said Act, for the words, figures and brackets "and into the value of the land at the date of the publication of the notification under section 4, sub-section (1)", the words, figures, letters and brackets "and into the value of the land on the 28th April, 1947 and the value of any agricultural improvements on the land commenced, made or effected after that date and before the date of publication of the notification under section 4, sub-section (1)" shall be deemed to have been substituted:-
(ii) In section 17, sub-section (2), clause (b), of the said Act, as amended by Madras Act XXI of 1948, after sub-clause (ii), the following shall be deemed to have been added, namely:-
"or
(iii) for the purpose of working lignite mines in the areas to which the Madras Lignite (Acquisition of Land) Act, 1953, extends;".
(iv) In section 23, sub-section (1) for clause first, the following clause shall be deemed to have been substituted namely:-
"first the market value of land on the 28th April, 1947 and the value of any agricultural improvements on the land commenced, made or effected after that date and before the date of the publication of the notification under section 4, sub-section (1)."

Section 3 - Application of the Act to pending cases of acquisition
The provisions of section 2 shall, so far as may be, apply also to every case in which proceedings have been started before the commencement of this Act for the acquisition of any land in the areas to which this Act extends, provided that no award has been made by the Collector under section II of the Land Acquisition Act, 1894 (Central Act I of 1894), before such commencement.

Section 4 - Power to make rules
(1) The State Government may, by notification in the Fort St. George Gazette, make rules to carry out the purpose of this Act.
(2) All rules made under this section shall be laid for not less than fourteen days before the Legislative Assembly of the State as soon as possible after they are made and shall be subject to such modifications, whether by way of repeal or amendment, as that Assembly may make during the session in which they are so laid.
