The Himachal Pradesh Police (Amendment) Act, 2008 Complete Act - Bare Act

AN ACT to amend the Himachal Pradesh Police Act, 2007

[Act No. 17 of 2007]

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Fifty-Eighth Year of the Republic of India as follows :--

(1) This Act may be called The Himachal Pradesh Police (Amendment) Act, 2008.

(2) It shall be deemed to have come into force on 9th day of October, 2007.

In section 114 of the Himachal Pradesh Police Act, 2007.--

(a) in sub-section (1), after the words "or thoroughfare", the words and sign "within the limits of any municipal area," shall be inserted; and

(b) after sub-section (2), the following Explanation shall be inserted, namely:--

"Explanation.-- For the purpose of this section, the expression "municipal area" means the territorial area of the municipality constituted under section 3 of the Himachal Pradesh Municipal Act, 1994 (Act No. 13 of 1994), which may be a Nagar Panchayat or a Municipal Council or a Municipal Corporation.".

The Himachal Pradesh Police Ordinance, 2007 is hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the Ordinance so repealed, shall be deemed to have been done or taken under the corresponding provisions of this Act.
